Terms of Use

1. Nature of the Service

EnoTourismClub ("ETC") operates exclusively as a digital intermediation platform that facilitates contact between users and independent service providers, including but not limited to wineries, hotels, and other tourism operators (the "Providers").

ETC does not:

• organize, design, or create travel experiences
• combine or package services into a single offer
• act as a travel agency or tour operator

All services displayed on the platform are created, managed, and provided directly by the Providers.

2. No Package Travel

The services offered on ETC do not constitute "package travel" within the meaning of applicable regulations (including Directive (EU) 2015/2302), as:

• Each service is offered and contracted individually
• ETC does not combine multiple services into a single contract or unified price
• Any selection of multiple services by the User is made independently and at their own discretion

Accordingly, ETC shall not be considered an organizer or retailer of package travel.

3. Contractual Relationship

By making a booking, the User enters into a direct contractual relationship with the Provider. ETC is not a party to the contract for the provision of services.

The Provider is solely responsible for:

• the execution of the service
• compliance with applicable laws and regulations
• handling cancellations, changes, or claims

ETC's role is strictly limited to facilitating the booking process.

4. Payment Structure and Commission

EnoTourismClub operates under a commission-based model:

• Payments are processed through MONEI, a licensed payment service provider, and are captured into an account controlled by EnoTourismClub
• EnoTourismClub subsequently settles the amount due to the Provider, after deducting its intermediation commission
• EnoTourismClub does not store full credit or debit card details — these are handled directly and securely by MONEI

While EnoTourismClub collects payment on behalf of Providers for the purpose of processing transactions, this does notalter its role as an intermediary with respect to the underlying tourism service itself (see Section 1) — EnoTourismClub does not organize, control, or deliver the service, and remains not a party to the contract between User and Provider.

5. No Creation or Control of Services

EnoTourismClub does not:

• control, manage, or supervise the services provided by Providers
• guarantee the quality, safety, or legality of such services

All content, descriptions, pricing, and conditions are the sole responsibility of the Provider.

6. Limitation of Liability

To the fullest extent permitted by law:

• ETC shall not be liable for any failure, cancellation, delay, or improper performance of services by the Provider
• ETC shall not be responsible for any damages, losses, or claims arising from the contractual relationship between the User and the Provider

Any claim must be addressed directly to the Provider.

7. Regulatory Compliance of Providers

Each Provider represents and warrants that it:

• holds all required licenses, permits, and authorizations
• maintains appropriate insurance coverage
• complies with all applicable tourism and consumer protection laws

ETC assumes no responsibility for verifying such compliance.

8. Interpretation

These Terms shall be interpreted in a manner consistent with ETC's role as a neutral intermediary platform. Under no circumstances shall ETC be deemed to organize travel services, act as a tour operator, or provide package travel services.

9. Terms of Use

This document constitutes the Legal Notice and the Terms of Use governing access to, navigation of, and use of the EnoTourismClub website, available at enogastrotourism.com(hereinafter referred to as "the Website").

11. User Communications

The user assumes full responsibility for any communication sent in breach of these obligations and shall be solely liable for any false or inaccurate statements made.

Accessing, browsing, or using the Website implies that the user has read, understood, and expressly accepted, without limitation or reservation, all provisions contained in this Legal Notice and the Terms of Use. If the user does not agree with these terms, they must refrain from using the Website.

All information contained on this Website, including its graphic design and source code, constitutes a protected work whose intellectual property rights belong to EnoTourismClub and are safeguarded under applicable Intellectual Property laws. Any reproduction, distribution, public communication, transformation, modification, assignment, or any other use not expressly authorized by EnoTourismClub is strictly prohibited.

16. Exclusion of Liability in the Use of Content

EnoTourismClub does not guarantee the reliability, accuracy, adequacy, or suitability of the services and information provided through the Website. The content made available is of a general nature and does not constitute advisory or agency services of any kind.

Access to and use of the Website does not guarantee:

• the continuous availability of its content
• the absence of errors, viruses, or other harmful software
• the uninterrupted performance of the Website during user navigation
• any damages that the User may cause to themselves or to third parties as a result of non-compliance with these Terms

The Website may contain links or redirects to third-party websites. As EnoTourismClub does not have full control over such external content, it assumes no responsibility for the information, comments, or materials hosted on those websites.

EnoTourismClub shall not be responsible for content, information, or comments stored or published by third parties through its blog, social media channels, or any other platform that allows independent content publication.

17. Validity and Modification

EnoTourismClub reserves the right to modify, in whole or in part, the terms and conditions set forth herein at any time. Such modifications shall become effective upon their publication in the "Legal Notice" section of the Website, without any obligation to notify Users in advance.

EnoTourismClub reserves the right to terminate, suspend, or interrupt access to the Website and its content at any time and without prior notice. Users shall not be entitled to claim any compensation as a result of such actions.
